Terms of Service

Trace CRM is a lead management platform built for businesses running Meta Ads. It captures leads from Meta lead forms, organises them into a sales pipeline, enables call logging and follow-up tracking, and sends conversion signals back to Meta via the Conversions API (CAPI).

By subscribing to Trace CRM, you agree to these Terms of Service in full.

Logam Digital Pvt. Ltd. reserves the right to modify, suspend, or discontinue any part of the service with 30 days written notice to active subscribers. In the event of discontinuation, a pro-rata refund will be issued for any unused prepaid period.

• You must be 18 years of age or older and authorised to enter into contracts on behalf of your business.
• You are solely responsible for all activity that occurs under your account, including actions taken by your team members.
• Login credentials are non-transferable. Do not share your username, password, or access tokens with anyone outside your authorised team.
• Notify us immediately at info@logamdigital.com if you suspect any unauthorised access to your account.

• All prices are in Indian Rupees (INR) and are inclusive of applicable GST.
• Auto-renewal: Monthly subscriptions renew automatically on the same date each month. 6-Month plans renew at the end of the 6-month period. You will be charged the then-current rate unless you cancel before the renewal date.
• Cancellation: Cancel at any time by emailing info@logamdigital.com. Cancellation takes effect at the end of the current billing period. No partial refunds for unused days.
• Data on lapse: If your subscription lapses, your account and data are retained for a 90-day grace period. After 90 days, all data is permanently deleted with no possibility of recovery.
• Logam Digital Pvt. Ltd. reserves the right to change pricing with 30 days advance notice to existing subscribers.

• You own your lead data. All leads, contact records, pipeline data, notes, and call logs remain your property at all times. Logam Digital Pvt. Ltd. makes no claim of ownership.
• By using the platform, you grant Logam Digital Pvt. Ltd. a limited, non-exclusive licence to store, process, and transmit your data solely for the purpose of providing the Trace CRM service.
• Trace CRM is our IP. The platform, software, design, features, and all associated intellectual property are owned exclusively by Logam Digital Pvt. Ltd.
• You must not copy, reverse-engineer, decompile, resell, sublicence, or create derivative works from any part of the Trace CRM platform.

• Limitation of liability: Logam Digital Pvt. Ltd.'s total liability for any claim shall not exceed the total fees paid by you in the 3 months preceding the event giving rise to the claim.
• In accordance with Section 28 of the Indian Contract Act, 1872, the cap above is our maximum liability — not a total exclusion of your legal remedies.
• The service is provided “as is” with no guarantee of uninterrupted availability, error-free operation, or specific uptime unless separately agreed in an Enterprise SLA.
• We are not liable for lost leads, missed sales, reduced ad performance, Meta Ads account issues, or any indirect or consequential damages.

Trace CRM is a tool. You are the Data Fiduciary under the Digital Personal Data Protection Act, 2023 (DPDP Act) for all lead data you manage through the platform.

You confirm that you have a lawful basis to collect and process all lead data imported into or captured via Trace CRM, and that your use of Meta CAPI through the platform is compliant with Meta's terms and applicable Indian law.

You must not use Trace CRM to:

• Upload purchased, rented, or scraped lead lists obtained without the data subjects' consent
• Send unsolicited bulk messages or spam to leads in violation of applicable Indian law
• Attempt to access another customer's data, accounts, or systems
• Use the platform for any unlawful purpose or in violation of any applicable regulation
• Exceed the number of licensed users by sharing credentials

Logam Digital Pvt. Ltd. reserves the right to suspend or terminate your account without notice for violations. No refund will be issued for termination due to a violation of these terms.

• Governing law: These Terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts at Surat, Gujarat, India.
• Dispute resolution: Disputes shall first be attempted through good-faith negotiation (30 days). If unresolved, referred to binding arbitration under the Arbitration and Conciliation Act, 1996, with seat of arbitration in Surat, Gujarat.
• Severability: If any provision is found unenforceable, the remaining provisions continue in full force.
• Entire agreement: These Terms, together with our Privacy Notice and any Enterprise agreement, constitute the entire agreement between you and Logam Digital Pvt. Ltd.
• Changes: We will notify active subscribers by email at least 14 days before material changes take effect. Continued use after the effective date constitutes acceptance.
